              DEFINITIONS – “Tour Participant, Customer,  Passengers, You, Guest” means the person in whose name or on whose behalf the  booking is made.
 “Company, We, Us, Swayambhu  Tours, Managers, Tour Leader” means “Vedika's Holidays”. “Brochure”/ “Initial  Tour Programme” means “Tour Programme” sent to you by Vedika's Holidays. “Tour  Date “means actual departure date mentioned in “Initial Tour Programme” Booking  Form or Form means the form duly filled with all required details of the  passenger/passengers by the passenger/passengers.
 Service Providers means “any  vehicle operator, hotelier, hotel/ restaurant   owner, caterer, catering contractor, any owner of Airline, Shipping,  company or Railway, Air Ferry Boa/Cruise/Coach/owner or any other person or  organization who has been  selected by  the company to render services to the passengers.”
 SCOPE AND LIMITS OF OUR SERVICES AND ACTIVITIESVedika's Holidays is only a  Travel  organizer & coordinator  between service providers & passengers. We are not owner of any Hotel,  Airlines, Railways, Ropeways, Shipping Company, Motor, Buses, Transport  Vehicle, Service agency & therefore we are not able to control or operate  such services & hence we are not responsible for any injury, Loss, death,  damage to person or property caused by the act or default of the management,  employees or any service provider, owner of Shipping company, Airlines,  Railways, Bus, Transport Vehicles etc.

              2) Vedika's Holidays              HDFC  Bank                17978140000014 ACCEPTANCE OF TERMS AND CONDITIONSPassengers signature on the  booking form or paying the booking amount partially or fully shall mean  acceptance in totality of the ‘Terms & conditions’ contained herein by the  passenger/passengers. In case of one or more, but not all passengers signing  the ‘Booking Form’ it shall mean that the others have duly authorized the  concerned signing passenger/passengers. The booking advance is a mere  confirmation of participation for the tour but does not entitled any services,  Tickets, Reservations hotel accommodation etc. until the full payment has been  made.  The full payment must be made as  per the booking procedure mentioned in Initial Tour Programme.  Cancellation charges as well as terms &  conditions regarding Cancellation  will  be applicable with additional processing charges if the booking procedure has  not been followed and company will cancel your Tour Booking.
 NO REFUND IN CASE OF CHANGES IN  TOUR ITINERARYCompany reserves the right to  cancel, change or reschedule, tour partly fully without intimation &  reason. The Company reserves right to change, amend, alter, cancel  service provider, utility equipments, rout  and all services which are described in printed format or electronically  published format. In all such cases no compensation or refund will be made.
 INITIAL TOUR PROGRAMME (BROCHURE)  We publish Initial Tour  Programme & Tour Cost 6 months in advance & we take every effort to  make the brochure error free at the time of Advertising the Brochure, still  errors & omissions may appear in printing. SERVICES 
              A) Meals – Only Pure veg food for breakfast, lunch & dinner  prepared by company appointed cooks or service providers. No special diet will  be provided. Quantity of food/meals will be given on request.B) Hotel  Accommodation – Company selects A Grade  hotels having lift, A.C., Central heating Facility, Power Generators  facilities. All such facilities are solely at hoteliers discretion. C) Room  & Room Sharing - Self contained Room on Twin or triple Sharing basis for  those who are with family members. Those who are participated individually  (single person’s Booking) in a tour will get triple bedded Room or as per  availability of rooms in concerned Hotel, all individually (single members)  participated members have to accept room sharing with other individual (single)  participants, else extra charges as applicable according to respective hotels  should be paid on the spot for special room allotment on availability only.  Room size varies hotel to hotel. No star category hotel rooms are assured,  Rooms with attached toilet Bathrooms will be allotted throughout the tour, all  other amenities/facilities such as T.V. intercom etc. solely at hoteliers  discretion. Passengers have to strictly follow check in & check out timings  given by the respective hotelier. Early arrivals or late departures are  chargeable & all such charges are payable by the passengers before check  out of respective Hotel/s.D) Transfers/Sight seeing vehicles & seating arrangements. – Company arrange suitable vehicle depending upon group  size for all transfers & sight seeing. We arrange A.C./Non A.C., Buses,  Mini Buses, Jeep, Taxies for Transfers & Sight Seeing as per availability  of vehicles. Company will not arrange vehicle In high population areas or no  entry areas, restricted areas & passengers have walk or use available  transportation on their own, no expenses or compensation shall be given by the  company . No transportation will be arranged for shopping purpose.During all  tours Seat nos. will be allotted on rotation basis. Rotation will be explained  by tour leader during tour. Tour leaders decision will be final for seat  allotment & no complaint adjustment for seat allotment will be accepted.E) Railway/Air  Bookings – Company can  arrange Railway Reservaions / Air Bookings on request and all charges including  concerned fare, service charges, taxes etc. shall be payable by the  passenger/s, company does not take responsibility for particular class’  booking. F) Coolie  Service – We do not provide coolie  service on any Railway Station, Airport, Bus Stand, Public Stoppages. You will  get helpers to load & unload your luggage from Bus To Hotel Room &  Hotel Room to Bus once a day during tour only. This coolie service will be  given only for up to 15 Kg. luggage per person. Helper service is a  complementary service & will not be binding for Company & hence no  complaint shall be accepted, no compensation will be given.G) Loss or  Damages – Company is not responsible for  any loos or damage of personal or property during tour and it is advisable  not to carry unnecessary valuables during  tour and use safe deposit services on your own expense wherever available.H).Extra  service Extra charges – You are free to  use Hotel’s Telephone or ordering extra eatables/drinks or order any available  service by paying the cost of the same on your own expense all such expnses  have to be paid on the spot. I) Itinerary – Detailed day to day tour programme ,  Time Table & required details will be given 10 days before tour Date.  CHANGES IN INITIAL TOUR PROGRAMME We reserve the right to change any  brochure, Advertisement, information at any time and all such changes will be  binding on the tour participant, customer. Tour Itinerary, Tour cost, Tour  Date, Hotels, vehicles, Railway, Air reservations are subject to change.  Information about all such changes will be given at appropriate time to the  tour participant, customers.  CANCELLATION & REFUND TERMS AND CONDITIONS  if passengers   decide to cancel tour participation –I) IF Tour  Participant has to cancel the Tour due to any reason  and the passenger has to make written  application along with booking advance receipt issued by the company & the  cancellation will be treated on cancellation charges as follows –
 II)  Cancellation Charges -
 If written application receives  45 or more days before the Tour Date – 10 % of Total Tour Cost mentioned on  initial Tour Programme. If written application receives -
 
              between 31 to  46  days before the Tour Date – 20% of  Total Tour Cost mentioned on initial Tour Programme.between 30 to 15  days before the Tour Date – 30 % of Total Tour Cost mentioned on initial Tour  Programme.between 14 to 04  days before the Tour Date – 60 % of Total Tour Cost mentioned on initial Tour  Programme.between 01 to 03  days before the Tour Date – 80 % of Total Tour Cost mentioned on initial Tour  Programme.If written  application receives on the Tour Date or on Tour  – 100 % of Total Tour Cost mentioned on  initial Tour Programme. III) Cancellation  will be charged on Total Tour Cost mentioned on Initial Tour Programme. IV) Air  Ticket Cancellation / Air Ticket Change Penalties An air  ticket cancellation / air ticket change penalty of minimum Rs. 500.00 per  person will be charged by the company, for any changes to the airline  reservation or ticket required after the ticket is issued by the ticketing  agency.  Other penalties may also apply  and these vary by ticketing agency, fare category, and airline. Specific  cancellation terms & penalties are available upon request. Refunds for  cancelled airline tickets are not guaranteed and are at the sole discretion of  the ticketing agency and/or airline used and are dependent on fare category
 V) Tour  Cancellation by the company prior to departure Date -The Company reserves right to  cancel any Tour prior to departure without giving reason & The company will  return the full amount collected against booking of such Tour and all such  refund will be made without interest . All such refund will be made by account  payee cheque ((cross cheque) against receipt only and  no compensation will be applicable in any  case.
 Cancellation Charges for  Air/Rail reservations are applicable as per the rules of Airlines/Railways. Any  refund payable will be given to the passengers after receipt of refund from  respective Airlines/Railways.after deducting the processing charges.
 UNUSED TOUR ITEMS/ SERVICESNo  refund will be made for any unused accommodations, missed meals, transportation  segments, cruise portions, sightseeing tours or any other unused service. Such  unused items are neither refundable nor exchangeable (no exceptions).
 PHOTOGRAPHY The  Company reserves the right to take photographs during the operation of any  program and to use resulting photographs for promotional purposes
 RESERVATIONS TERMS FOR ALL TOURS / RESERVATIONS If  the balance payment for booking is not made per the schedule above for ANY  reason, reservations are treated as cancelled without possibility of any  refund. The bookings for train tours are taken on the rates valid at the time  of reservation and may change at the time of departure. In case of increase in  tariff at the time of travel, the new tariff will be applicable and billed back  to the passenger.
 Payment  of booking amount against any tour(s) or reservation(s) does not imply  rendering of any service and no services will be provided based solely upon  this deposit.  Payment of booking amount  guarantees rendering of purchased services once full payment has been received  in full by the company as per the Terms and Conditions. All reservations are  non-transferable under any circumstances. All reservations are subject to  cancellation without notice if payment terms are not adhered to. In such a  case, no refunds (partial or full) are due back to the passenger. A NOTE ABOUT PAYMENT TERMS FOR ALL TOURS / RESERVATIONS a) Payments  are accepted by bank transfer, or check drawn in favour of “Swayambhu  Tours”.
 b) Transaction  failures are subject to charge Rs. 500/- as transaction failure fee on the  second and each subsequent failed attempt.
 c) All  airline & Railway tickets charges are always extra payable & may be  paid by check or cash. Please contact us for alternative payment methods.
 d) Clients  are responsible for any and all legal/collections fees associated with all  collections matters in case the payment is not received.
 NO-SHOWS: In  the event of a no-show for all or part of a tour, this will be treated as a  cancellation and the 100% cancellation penalty remains in effect, and no  refunds, either full or partial, will be due back to the client.
 CHANGE OF DATE/OCCUPANCY/NAME/SCHEDULE  BY YOU (not including changes to  itinerary)a)  Change of date/occupancy/name/schedule WITHIN SAME TRAVEL SEASON may be  possible if requested up to 65 days prior to the first scheduled service of the  tour. For certain tours, change of date/name/occupancy/schedule will NOT be  possible. No changes will be permitted within 65 days of the first scheduled  service; any requests for such are not guaranteed and will be considered on a  case-by-case basis.  Change of  date/occupancy/name/schedule is subject to availability and at the sole  discretion of the company.
 b) Downgrade  in occupancy after the deposit payment is collected (i.e. reducing the number  of travelers) is considered a cancellation of the full tour and is subject to  the cancellation penalties associated with your tour / reservation.  Any fees associated with change of  date/occupancy/name/schedule will be informed to the passenger.
 c) Fees  associated with change of date/occupancy/name/schedule do NOT cover the cost of  change to airline & Railway tickets used in the tour. Cost of airline  tickets changes are additional and will be billed back to the passenger and all  bills should be settled at least 30 days prior to first service sold by the  company otherwise the entire tour or portions thereof can be cancelled without  notice to the passenger and the company will not be liable to pay any refunds  or liabilities implied or direct to the passenger due to lapse in service.
 PRICES, RATES & FARES  Unless  otherwise indicated all prices / rates shown are in Indian Rupees. In certain  cases, Vedika's Holidays and its offices, vendors and contractors, authorize  representatives who are paid in local currencies and all rates are quoted in Indian  Rupees which get impacted with the foreign exchange fluctuations. We, upon  request will disclose the exchange rate being used for your tour. The Company reserves  the right to apply a currency surcharge if needed before accepting the final  payment of the tour. Clients may have the option to lock in the rates for the  tour in such circumstances by paying for the tour in full at the rates  applicable at the time of payment. Please contact us for details. The Company  reserves the right to increase tour prices to cover increased costs of tariffs  and taxes. International airfares (if shown) should be used as a guideline  only. Best available airfares will be quoted, applicable at time of departure,  based on individual gateways for the complete air itinerary.
 TRAVEL DOCUMENTS  All  passengers must be in possession of a valid Identity card (i.e. any photo ID issued  by GOVT. Of India)  passport; its validity must be for six (6) months beyond the re-entry date into  the passenger’s home country. A visa or visas may be required for some or all  of the countries visited on the tour selected. Please check your visa requirements  at time of booking. It is the passenger’s responsibility to ensure that all his  or her visa and passport requirements are met.
 TOUR INFORMATION & DOCUMENTS  Acknowledgement  of booking will be sent immediately upon complition of a reservation. Final  tour documents consisting of detailed tour itinerary, tour vouchers, hotel  vouchers, airline electronic ticket (“e-ticket”) copies etc. as applicable will  be dispatched electronically or sent through corier/post from our offices  approximately 20–15 days prior to departure. If documents are required or  requested for earlier delivery, and/or for delivery of hard copies of the  documents by mail/courier outside of the State, a fee of Rs.50.00 will apply to  cover extra handling and processing.
 INSURANCE  the  company strongly recommends purchasing travel insurance that protects you and  your investment in the event of a sudden emergency before or during your trip  and coverage for trip cancellation or interruption, illness, injury, and  damage, loss or theft of baggage, as well as emergency assistance.  Please contact the company office for more  information.
 HEALTH REQUIREMENTS  We  strongly recommend that you consult with your personal physician. If you have  any medical condition or allergy that may interfere with your trip, you are  required to complete a “Medical Waiver” and your physician must certify that  you are fit to travel. Failure to complete and return this waiver to the  company may result in cancellation of your tour without a refund. In absence of  a waiver, the company deems that you are fit to travel.
 RESPONSIBILITY–LIMITATION OF LIABILITY  the  company and all affiliates (herein referred to as “THE COMPANY”) act only in  the capacity as an agent for the hotels, airlines, bus companies, railroads,  ship lines, and/or contractors providing accommodations, transportation or  other services to the passenger. The passenger is advised that the company  purchases such transportation, hotel accommodations, restaurant and other  services from various independent suppliers, service providers who are not  affiliated with the company. Company makes every effort to select the best  suppliers of the aforementioned services, however, the company does not control  the operations of these agents and as a result, CANNOT BE HELD LIABLE FOR ANY  PERSONAL INJURY, PROPERTY DAMAGE OR OTHER CLAIM which may occur as the result  of any and/or all of the following: (1) the wrongful, negligent or arbitrary  acts or omissions on the part of the independent supplier, agent, its employees  or others who are not under the direct control or supervision of the company;  (2) defects or failures of any vessel, aircraft, vehicle or other  instrumentality which is under the control of an independent supplier; or (3)  loss, injury or damage to person, property or otherwise, resulting directly or  indirectly from any natural calamities,, dangers incident to the sea, river  fire, breakdown in machinery or equipment, or wars (whether declared or not),  hostilities, civil disturbances, strikes, riots, thefts, pilferage, medical  epidemics, quarantines, or customs regulation, defaults, delays or  cancellations or alterations in itinerary due to schedule changes, or from any  causes beyond the company’s control. Further, the company is not liable for any  loss or damage resulting from insufficient or improperly issued Identity Cards,  passports, visas or other legal documents. All coupons, exchange orders,  receipts, contracts and tickets issued by the company are issued subject to any  and all tariffs, terms, and conditions under which any services are provided by  such hotels, airlines, bus companies, railroads, ship lines or owners or  contractors or by any person in their employ. The  company in no way guarantees the quality,  authenticity, or value of any good(s) purchased by the passenger during any  tour.  The company shall in no event be  responsible or liable for any direct, indirect, consequential, incidental,  special or punitive damages arising from your interaction with any  retailer/vendor, and the company expressly disclaims any responsibility or  liability for any resulting loss or damage.
 RESERVATION OF RIGHTS  The company  (when deemed necessary) reserves the right to: (1) cancel any itinerary or any  part of it; (2) make any alterations to the itinerary (including but not  limited to substitution of hotels, attractions, destinations, and the order of  the itinerary) taking into consideration the practicality of the itinerary or  to accommodate any unforeseen issues that may arise on the ground; and (3)  decline to accept or to retain any person as a tour passenger should such  person’s health, mental or physical condition, in the sole opinion of the company,  impede the operation of the tour of the other passengers. Tour passengers are  held responsible for being in sufficient good health to undertake the tour. If  a passenger is asked to leave while the tour is in progress, that person will  be responsible for charges incurred on account of such departure from the tour  and/or return to his/her home country. In such a case, the company will not  refund any monies. The Company will accept no further liability or obligation  toward that person or third party.
 PRIVACY POLICY  The  the company policy is to protect and respect the privacy of our users. the company agrees to exercise  reasonable precautions to maintain the confidentiality of information provided  by you in connection with accessing this web site. the company does not collect  personal information about individuals from this Site except when specifically  and knowingly provided by such individuals and will not sell, rent, or trade  personal information about our users to any third party. Notwithstanding the  foregoing, the  company may disclose personal information in special cases: (1)  when we have reason to believe that disclosing this information is necessary to  identify, contact, or bring legal action against someone who may be causing  injury to or interfering with (either intentionally or unintentionally) the company’s rights or property; (2) when, after  good faith research, we believe that the law requires it; (3) to the company’s sales and marketing personnel and its suppliers, business partners, regional  managers and/or sales representatives as necessary to provide service or  information to you that you have requested; and (4) in situations involving  threats to the physical safety of any person.
 When you give us your personal or corporate information (e.g. name, bierth  date, address, phone, fax, e-mail, etc.), we will not sell, trade, or give this  information to any third party. Your personal information will only be used to  improve our relationship with and the services provided to you.
 DISCLAIMER The company  is not responsible for any errors, omissions or misquotes contained in this  document or any other accompanying promotional documentation. The contents of  said document or promotional documentation may be changed anytime (including  but not limited to rates and itinerary) without notice and at the company’s  sole discretion.
